Union MoS Nityanand Rai Introduces Immigration and Foreigners Bill 2025 in Lok Sabha: Aims to Modernize Immigration Laws

On March 11, 2025, Union Minister of State for Home Affairs, Nityanand Rai, introduced the Immigration and Foreigners Bill, 2025, in the Lok Sabha. This legislative proposal aims to modernize India’s immigration framework by consolidating and replacing four existing laws: the Passport (Entry into India) Act, 1920; the Registration of Foreigners Act, 1939; the Foreigners Act, 1946; and the Immigration (Carriers’ Liability) Act, 2000.

Key Provisions of the Bill

  • National Security Measures: The bill introduces provisions to deny entry to foreigners deemed a “threat to national security,” enhancing the government’s ability to safeguard the nation.
  • Streamlined Procedures: By consolidating multiple laws, the bill seeks to simplify visa policies, increase penalties for violations, and enforce stricter control over foreigner registration. This aims to create a more efficient immigration system.
  • Enhanced Enforcement: The legislation proposes stricter regulations on the entry, stay, and deportation of foreigners, aiming to strengthen border security and improve the regulation of foreign nationals within India.

Opposition’s Concerns

The introduction of the bill has met with resistance from opposition parties. Congress MP Manish Tewari labeled the bill “unconstitutional,” arguing that it violates fundamental rights on multiple counts. He highlighted the absence of an appeal mechanism against decisions taken by immigration officers as a significant concern.

Further objections were raised regarding the bill’s potential to infringe upon constitutional provisions and fundamental rights. Opposition members have called for the bill to be referred to a Parliamentary select committee for detailed scrutiny before its passage.

Government’s Stance

Defending the bill, Nityanand Rai stated that the proposed legislation is not intended “to stop anyone from coming to India.” He emphasized that the bill aims to replace outdated laws with a comprehensive framework to better manage immigration and enhance national security.

As the bill progresses through the legislative process, it is expected to be a focal point of intense debate, reflecting the broader discourse on balancing national security with individual rights.
