Supreme Court Halts Fresh Appointments Under Waqf (Amendment) Act, 2025 Until Next Hearing
New Delhi, April 17:
In a significant development, the Supreme Court today recorded the Union government’s assurance that no fresh appointments will be made to the Central Waqf Council or any state waqf boards under the newly amended Waqf (Amendment) Act, 2025, until the next hearing of the matter.
A bench comprising Chief Justice Sanjeev Khanna and Justices Sanjay Kumar and K.V. Viswanathan took note of Solicitor General Tushar Mehta’s statement that the status quo will be maintained regarding existing waqf properties. This includes those categorized as “waqf by user,” a classification under legal scrutiny.
The court directed the central government to file its response within seven days to a batch of petitions challenging the constitutional validity of the 2025 amendments to the Waqf Act, 1995. Several petitioners have sought a stay on the operation of the amendments.
