Girish Chodankar Moves HC Against Speaker’s Order, Seeks Disqualification of MLAs

Panaji, December 20, 2024: In a significant legal move, Congress leader Girish Chodankar has filed a writ petition (WP/3220/2024(F)) before the Goa Bench of the Bombay High Court, challenging the order dated November 1, 2024, issued by the Speaker of the Goa Legislative Assembly.

The petition, filed in accordance with the directions of the Supreme Court, seeks judicial intervention to set aside the Speaker’s order and impose restrictions on the involvement of certain legislators in the Assembly proceedings and government positions.

Key Prayers in the Petition:

1. Quashing of the Speaker’s Order – Chodankar has urged the High Court to issue a writ of Certiorari, setting aside the Speaker’s order.

2. Restraining MLAs from Assembly Participation – The petition seeks to bar respondents No. 2 to 9 from taking part in the proceedings of the Goa Legislative Assembly until the case is resolved.

3. Ban on Ministerial Appointments – The petitioner has also requested the court to prevent the same respondents from being appointed as ministers in the state government while the matter is sub judice.

4. Further Necessary Relief – The petition prays for any additional relief the court may deem appropriate in the interest of justice.

Legal and Political Implications

Chodankar’s petition is expected to have far-reaching political consequences in Goa, as it challenges the legitimacy of certain MLAs and their roles in governance. This case follows the Supreme Court’s recent directives, underscoring the growing judicial scrutiny over legislative decisions in the state.

The matter is now pending before the High Court, and its outcome could significantly impact the political landscape of Goa.
